These Terms of Service ("Terms") govern your use of the Soniche mobile application ("App") and related services provided by Soniche ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.
1. Eligibility
You must be at least 13 years old to use Soniche. If you are under 18, you must have parental or guardian consent. By using the App, you represent that you meet these requirements.
2. Account Registration
You may create an account using Apple Sign In, Google Sign In, or email registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
3. Medical Disclaimer
Soniche is not a medical device and does not provide medical advice, diagnosis, or treatment. Facial analysis scores and reports are generated using anthropometric algorithms and are intended for informational and entertainment purposes only.
- Results should not be used to make medical, surgical, or cosmetic procedure decisions
- Scores are based on population-level statistical norms and do not represent clinical assessments
- Always consult qualified healthcare professionals for medical advice
- We make no warranties regarding the accuracy or completeness of analysis results
4. Acceptable Use
You agree not to:
- Use the App to scan, analyse, or score other people without their explicit consent
- Use results to harass, bully, or discriminate against any person
- Reverse-engineer, decompile, or attempt to extract the source code of the App
- Use the App for any unlawful purpose
- Circumvent any security features or access controls
- Create multiple accounts to abuse free-tier limitations
5. Subscriptions & Payments
5.1 Free Tier
The free tier provides limited access to facial analysis features, including basic scoring and a limited number of analyses.
5.2 Premium Subscription
Premium features are available via auto-renewing subscription at $4.99/month or $29.99/year, billed through the Apple App Store. Prices may vary by region and are subject to change.
5.3 Billing & Cancellation
- Subscriptions automatically renew unless cancelled at least 24 hours before the current period ends
- You can manage or cancel your subscription in your device's App Store settings
- No refunds are provided for partial billing periods
- Refund requests are handled by Apple per their App Store refund policy
6. Intellectual Property
The App, including its design, algorithms, scoring models, content, and underlying technology, is owned by Soniche and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
7. User Content
You retain ownership of photographs and scan data you submit through the App. By using the App, you grant us a limited license to process, store, and analyse this content solely for the purpose of providing the service.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Soniche shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to emotional distress, loss of data, or reliance on analysis results.
Our total liability for any claim arising from these Terms or the App shall not exceed the amount you paid for the service in the 12 months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless Soniche, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.
10. Termination
We may suspend or terminate your account at our discretion if you violate these Terms. Upon termination, your right to use the App ceases immediately. You may delete your account at any time through the App settings.
11. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated through the App. Your continued use after changes constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms shall be resolved through binding arbitration, except where prohibited by law.
